The law regarding the use of criminal record checks by employers is complex. What can and can’t employers do when it comes to criminal record checks, and how can they be used?


These are not easy questions. The law on criminal records applies not only to job applicants, but also to individuals already in employment.

There are two ways in which an employer can get information about a person’s criminal record history. They can either seek a voluntary disclosure from the candidate about their criminal convictions, or an employer can seek an official criminal record check through the Disclosure and Barring Service (DBS).
